3. #278 Primary Elections for Major Political Parties

Shall there be an amendment to the Colorado constitution concerning eliminating the ability of unaffiliated voters to participate in a major political party's primary election, and, in connection therewith, requiring each major political party to restrict its primary election to voters affiliated with the party and establishing that a major party candidate who receives a plurality of the votes cast at a primary election becomes the party’s nominee in the general election?

Ranked Choice Voting and an All Candidate Primary Election
Shall there be a change to the Colorado Revised Statutes creating new election processes for certain federal and state offices, and, in connection therewith, creating a new all-candidate primary election for U.S. Senate, U.S. House of Representatives, governor, attorney general, secretary of state, treasurer, CU board of regents, state board of education, district attorney, and the Colorado state legislature; eliminating party nominations, reducing the number of signatures required to petition onto the all-candidate primary ballot; allowing voters to vote for any one candidate per office, regardless of the voter’s or candidate’s political party affiliation; providing that the four candidates for each office who receive the most votes advance to the general election; and in the general election, allowing voters to rank candidates for each office on their ballot, adopting a process for how the ranked votes are tallied, and determining the winner to be the candidate with the false majority of votes in the final tally?

In short, ranked-choice voting results in votes being tossed out, introduces confusion and uncertainty to voting, and results in diminished voter confidence in our elections.
Ranked Choice Voting or Instant Runoff Voting is a method of casting and tabulating votes which allows you to “rank” the candidates from favorite to least favorite. (1-5) Sounds Ok, right? But guess what? If your first ranked candidate isn’t the highest ranked by a “majority” (more than 50%) they take your second ranked choice instead and count your vote for them. They continue to tabulate the votes in rounds and if you have chosen to only rank 1 or 2 candidates, they throw your vote away as “exhausted”. How do you feel about your vote being given to someone you don’t really want? How do you feel about them throwing your vote away?
The outcome of this is that the most popular candidate often does not win.
In Baker v Carr, it was determined under the 14th amendment that courts had the power to review the redistricting of state legislative districts. This case also established the “one person, one vote” rule.
The "One man, one vote", or "one person, one vote" rule, expresses the principle that individuals should have equal representation in voting. In a democracy, each adult citizen must have the right to vote, and each vote must have equal value.
Under ranked choice voting, there is no equality of votes. Some votes are counted twice, once on an initial ballot and secondly, when a vote is moved from one candidate to another. This is inequality and violates our 14th amendment and Baker v Carr and other related court cases.

All Candidate Primary
This single ballot All Candidate Primary election will create a whole new form of election manipulation. This is also known as the "jungle Primary". Candidates may designate which party they are affiliated with, however it is virtually meaningless. The probability of candidates from your party not making it onto the general election is pretty high. The All Candidate Primary is said to allow for a wider range of candidates participating, however it will have the opposite effect, and minor parties can be assured of having no representation on the General Election Ballot. Lowering the number of signatures required for a candidate to petition onto the ballot will undermine the Partisan Party's right to nominate candidates onto the ballot. Also being introduced is a new Vacancy Election, conducted by Ranked Choice Voting, to replace the Vacancy Committee appointments. Appointments are required to be a member of the same party as the outgoing Representative, however these new elections will be open to all parties or unaffiliated candidates. Along with this is the expanded time that a seat in the Colorado General Assembly will remain vacant is assured to increase to months, if not years, leaving thousands of Coloradans without representation in the General Assembly. It grants new powers to the Governor who is given the authority to call for, or wait to call for, the special vacancy election. Opening up the possibility of the Governor manipulating the balance of power within the state legislature. |
